What this calculator does

South Australia imposes stamp duty (transfer duty) on conveyances of real property under the Stamp Duties Act 1923 (SA). Rates are progressive, starting at $1 per $100 for the first band and rising to $5.50 per $100 on higher bands. An off-the-plan concession applies where the contract is entered into before construction is complete, and a foreign ownership surcharge of 7% applies to foreign purchasers of residential land.

Legal basis

SA transfer duty is imposed under the Stamp Duties Act 1923 (SA), Part 2 (conveyances). The foreign ownership surcharge sits in s 72A. The off-the-plan concession is administered under RevenueSA rulings. Rates are set out in Schedule 2.

How the calculation works

Apply the RevenueSA progressive rate schedule under Schedule 2 of the Stamp Duties Act 1923 (SA) to the property value. If the purchase is off-the-plan, apply the off-the-plan concession (duty is calculated on the land value component only, excluding future construction). If the buyer is a foreign purchaser, add the 7% foreign ownership surcharge under s 72A on the full consideration.

Are these RevenueSA rates current?

The calculator uses the RevenueSA rate schedule as at the build date. SA stamp duty rates have been stable but should always be confirmed against revenuesa.sa.gov.au before settlement.

How does the off-the-plan concession work?

For off-the-plan purchases, duty is calculated on the land value component only, excluding the cost of construction yet to be completed. The concession requires a valuer to apportion the land and building components.

What is the foreign ownership surcharge?

Under s 72A of the Stamp Duties Act 1923 (SA), foreign purchasers of residential land pay a 7% surcharge on the full consideration, in addition to the standard transfer duty.

Is the first home owner grant included?

No — the first home owner grant is a separate cash payment administered by RevenueSA and does not reduce the transfer duty payable. It is not modelled in this calculator.

Does SA have a first home buyer duty concession?

SA does not currently offer a general stamp duty concession for first home buyers on established homes, unlike some other states. The first home owner grant applies to new homes only.

Is this legal advice?

Does stamp duty apply to vacant land?
