Legal basis
Tasmanian transfer duty is imposed under the Duties Act 2001 (Tas), Chapter 2. The first home buyer duty concession is provided under s 36AA. The foreign investor duty surcharge sits in Chapter 2A (s 36D onwards). Rates are set out in Schedule 1.
How the calculation works
Apply the Schedule 1 rate table from the Duties Act 2001 (Tas) to the dutiable value. If the buyer is a first home buyer purchasing below the concession threshold, apply the s 36AA concession (50% duty reduction, phasing out above the lower threshold). If the purchaser is a foreign investor, add the 8% surcharge under Chapter 2A on the dutiable value.
