QLD buyer-side residential conveyancing checklist
Queensland residential conveyancing uses the REIQ contract and runs under the Land Title Act 1994 and Property Law Act 1974. This checklist is for Queensland solicitors acting for residential buyers.
This is a 12-step Queensland buyer-side conveyancing checklist covering the REIQ contract, cooling-off, searches, transfer duty, and settlement for residential purchases.
The checklist
Review the REIQ contract
Check the REIQ Contract for Houses and Residential Land, special conditions, and disclosure obligations.
Advise on the 5 business day cooling-off
Brief the buyer on Queensland cooling-off rights and the 0.25% termination penalty.
Verify finance condition
Confirm finance is approved and notify the seller by the finance date to keep the contract on foot.
Arrange building and pest inspections
Confirm building and pest reports under the contract and advise on any grounds to terminate.
Run title and local authority searches
Order title, plan, council rates, water, and Transport and Main Roads searches.
Check for registered encumbrances
Review easements, covenants, caveats, and any unregistered interests disclosed in the contract.
Calculate transfer duty
Calculate QLD transfer duty and check for first home concession, home concession, or additional foreign acquirer duty.
Prepare the Form 1 Transfer
Draft the Form 1 Transfer and confirm client VOI and authority to deal.
Coordinate PEXA workspace
Invite parties into the PEXA workspace and upload documents for electronic settlement.
Calculate adjustments
Calculate council rates, water, and body corporate levy adjustments as at settlement date.
Attend settlement
Confirm workspace balance, coordinate lender funds, and settle at the agreed time.
Post-settlement steps
Confirm title registration, provide settlement statement, and advise on insurance and council notification.
