VIC mortgage registration checklist

Victorian mortgage registration is governed by the Transfer of Land Act 1958 and managed through Land Use Victoria. This checklist is for VIC solicitors and conveyancers registering a new mortgage.

Verify borrower identity

Complete VOI per Victorian Registrar's Requirements and retain evidence.

Obtain client authorisation

Obtain the borrower's client authorisation for electronic signing.

Check title search

Run a current title search and confirm registered proprietor, encumbrances, and priority.

Prepare mortgage form

Prepare the Mortgage of Land form in PEXA referencing the lender's memorandum of common provisions.

Confirm MCP registered

Confirm the memorandum of common provisions is registered at Land Use Victoria.

Assess mortgage duty

Confirm mortgage duty abolished in Victoria from 1 July 2004 and no duty payable.

Calculate lodgement fee

Calculate Land Use Victoria lodgement fee and account for it in PEXA.

Obtain lender execution

Coordinate digital signing by the lender's PEXA subscriber.

Coordinate with outgoing mortgagee

If refinancing, coordinate with the discharging mortgagee to release title.

10

Settle and lodge

Complete PEXA settlement and lodge the mortgage for registration.

Confirm registration

Run post-lodgement title search to confirm the mortgage is registered.

Send confirmation to lender

Provide the lender with registered title search and close the matter.
