This is a 12-step checklist for preparing a bail continuation application in NSW. It covers compliance history, conditions, concerns and submissions.
The checklist
Confirm current bail conditions
Review the current bail acknowledgment and each condition.
Check compliance history
Review any breach allegations, missed reporting or non-compliance.
Identify bail concerns
Identify the current bail concerns under s 17 — failure to appear, commit offence, endanger safety, interfere.
Identify unacceptable risk
Prepare submissions on why there is no unacceptable risk under s 19.
Consider show cause
If a show cause offence, identify what establishes cause under s 16A.
Propose bail conditions
Propose conditions that address each bail concern — conduct, reporting, residence, sureties.
Prepare surety evidence
If a surety is offered, obtain evidence of the surety's means and willingness.
Prepare accommodation evidence
Confirm the proposed residence is available and suitable.
Prepare employment evidence
Letter from the employer confirming employment and hours.
Prepare health evidence
Medical evidence if health is relevant to bail (e.g. custody hardship).
Draft the submission
Draft short oral or written submissions addressing each bail concern.
Confirm attendance
Confirm the client is at court on time and dressed appropriately.
