Identify the defendant
Identify the creator of the nuisance, and whether occupier or landlord should be joined.
Serve notice to abate
Serve a letter of demand requiring abatement of the nuisance.
Consider council involvement
Consider whether a council order under public health or planning law is available.
Quantify damages
Quantify damages for loss of enjoyment, diminution in value, or remedial costs.
Consider injunctive relief
Assess whether an injunction is the primary remedy sought.
Prepare pleadings
Prepare statement of claim in the appropriate court with particulars.
