Identify the type of amendment

Correction, further particulars, new cause of action or new party. Each has different rules.

Check if leave is required

Amendment without leave is possible before certain steps. Otherwise apply under Pt 19.

Consider consent

Consent amendments avoid a contested motion. Seek consent first.

Check limitation periods

Adding a new cause of action after limitation has run requires special rules on relation-back.

Check joinder of parties

Joining or substituting parties requires leave and, in some cases, fresh originating process.

Prepare the amended pleading

Mark up the amendments in colour (or underline/strikethrough) and file a clean version.

Consider costs consequences

Amendments usually carry indemnity costs thrown away. Address costs in the orders sought.

Re-verify if required

Some amended pleadings require re-verification.

Serve the amended pleading

Serve on all parties and any joined party within the rules.

Diary the response window

An amended defence or reply may be required. Diary the time for response.

Update the court file

Update court book references, chronology and any related interlocutory orders.
