Prepare the linen plan

Finalise the linen plan (plan of subdivision) with the surveyor, ensuring lot boundaries, easements, and areas comply with the consent.

Draft the section 88B instrument

Prepare the section 88B instrument creating or releasing easements, restrictions on use, and positive covenants as required by the conditions.

Obtain council endorsement of the plan

Submit the linen plan, section 88B instrument, and evidence of condition compliance to council for endorsement.

Apply for the subdivision certificate

Apply to the consent authority for a subdivision certificate under section 4.28 of the EP&A Act, attaching all required clearances and endorsed plans.

Pay section 7.11 or 7.12 contributions

Calculate and pay any outstanding development contributions required under section 7.11 or 7.12 of the EP&A Act before certificate issue.

Lodge the plan at NSW LRS

Lodge the subdivision plan, section 88B instrument, and subdivision certificate at NSW Land Registry Services for registration.

Resolve any LRS requisitions

Respond to any requisitions raised by NSW LRS — these commonly relate to plan format, easement descriptions, or instrument execution.

Confirm new title creation

Verify that separate certificates of title have been created for each new lot and that all easements and restrictions are correctly recorded.
