VIC caveat lodgement checklist
Victorian caveats are lodged under section 89 of the Transfer of Land Act 1958. A caveator must hold an estate or interest in the land and faces section 118 compensation if the caveat is lodged without reasonable cause.

The checklist
Establish a caveatable interest
Confirm the client has a legal or equitable interest — purchaser, unregistered mortgagee, trust beneficiary, or similar.
Collect supporting documents
Gather the contract, loan agreement, trust deed, or other instrument creating the interest.
Run a title search
Run a current title search and confirm the registered proprietor and encumbrances.
Warn client on section 118
Advise the client on compensation exposure under section 118 for lodging without reasonable cause.
Draft the caveat form
Prepare the caveat in PEXA with a clear description of the estate or interest claimed.
Verify caveator identity
Complete VOI per Victorian Registrar's Requirements.
Execute caveat
Coordinate electronic execution of the caveat by caveator or practitioner.
Lodge via PEXA
Lodge the caveat electronically through PEXA or paper at Land Use Victoria.
Pay lodgement fee
Pay Land Use Victoria lodgement fee and retain the receipt on file.
Confirm registration
Run a post-lodgement title search to confirm the caveat appears on title.
Diarise lapsing period
Diarise the 30 day period to commence proceedings if a lapsing notice is served.
Notify client
Notify the client of registration and the steps required if the caveat is challenged.
