The checklist
Confirm executor is willing to act
Confirm the named executor consents to apply and has not renounced.
Locate the original will
Locate the original will and any codicils. Check for signs of alteration or revocation.
Prepare the death certificate
Obtain the death certificate and confirm the date and place of death.
Identify assets and liabilities
Identify estate assets, values at date of death, and all outstanding liabilities.
Advertise on the Supreme Court website
Advertise the intention to apply on the Supreme Court website 14 days before application.
Prepare affidavit of executor
Draft the affidavit of executor setting out will validity, death, and the assets and liabilities.
Prepare inventory of assets
Prepare the inventory of assets and liabilities in the correct form for the affidavit.
Lodge original will and codicils
Lodge the original will, codicils, death certificate, and affidavit with RedCrest.
Pay court fees
Calculate and pay the probate fee based on the gross estate value.
Respond to Registry requisitions
Respond to any Registry requisitions or further affidavits required.
Receive the grant of probate
On issue, obtain certified copies for use in dealing with estate assets.
Notify asset holders
Send the grant to banks, super funds, share registries, and Land Use Victoria for asset transfer.
