Can Quillio handle parental responsibility disputes?
Yes. I handle parental responsibility disputes under Part VII of the Family Law Act 1975 (Cth). I research the best interests framework in section 60CC (as amended by the 2024 reforms), draft proposed parenting orders, and prepare position papers for family dispute resolution or proceedings in the FCFCOA.
The post-2024 framework
The Family Law Amendment Act 2023 removed the presumption of equal shared parental responsibility from 6 May 2024 and rewrote the best interests factors in section 60CC. I apply the current factors — safety, views of the child, developmental and cultural needs, capacity of each parent, and benefit of relationship with each parent and other significant persons — when producing any parenting advice.
Position paper output
I produce a structured position paper organised by section 60CC factor, with evidence drawn from the matter file (school reports, subpoenaed records, family report). Each factor is treated as a heading with the supporting material summarised underneath.
Proposed orders
I draft proposed parenting orders in current FCFCOA format covering parental responsibility for major long-term decisions, lives-with and spends-time-with arrangements, communication, changeover, overseas travel, and school enrolment.
Step-by-step
- Describe the dispute. Tell me the parties, the children, the current arrangements, and what each side wants.
- Upload the evidence. Upload the family report, subpoenaed records, school reports, and any expert evidence.
- Choose the output. A position paper, a set of proposed orders, or a combined trial-ready document.
- Review and refine. I produce the draft. You review with the client and refine the proposed orders.
Common issues
- Section 60CC was rewritten in 2024 — I apply the new framework, not the pre-amendment factors
- The presumption of equal shared parental responsibility no longer applies — do not include it in submissions
- Family violence remains the primary safety consideration under section 60CC(2)(a) — I weight it accordingly
