What I check

I read every clause against the relevant Retail Leases Act (for example, Retail Leases Act 2003 (VIC), Retail Leases Act 1994 (NSW)) and the standard commercial lease risk checklist: term and options, rent review method, outgoings definition, make-good obligations, assignment and sublet, guarantor liability, default and termination, and bank guarantee amount. I also check for missing disclosures where the lease is a retail lease.
