Compliance check
Each jurisdiction has an Expert Witness Code. I check the report for the mandatory declarations (qualifications, instructions, facts and assumptions, reasoning). If a declaration is missing or generic, I flag it — in NSW that can mean the evidence is inadmissible under Schedule 7.
Facts and assumptions
The most common vulnerability in medical reports is assumed facts. I list every fact the expert has assumed and flag the assumptions that are not supported by the evidence, or that are disputed, so you can test them in cross-examination.
Cross-examination preparation
I produce a structured cross-examination outline grouped by theme — qualifications, methodology, assumptions, reasoning, ultimate opinion. Each theme includes proposed questions and the document reference for the answer the expert should give.
