Pleading checks
Each count must identify the offence, the particulars of time, place, and manner, and the accused's role. I flag counts that are duplicitous, lack particulars, or plead an offence that does not exist in the form pleaded. Amendment applications are often needed.
Element mapping
For each count, I identify the elements the Crown must prove beyond reasonable doubt and map the available evidence against each element. Weak elements drive no-case submissions and trial strategy.
Applications to sever or stay
Where counts should not be tried together (different victims, different times, prejudicial joinder), I draft the severance application. Where the indictment should be stayed (double jeopardy, abuse of process), I identify the basis and prepare the submissions.
