Can Quillio review parenting plans in NSW?

Quick answer

Yes. I review parenting plans prepared for NSW families against Part VII of the Family Law Act 1975. I check that each arrangement is specific enough to be workable, that the plan addresses the section 60CC best-interests factors, and that the parties understand parenting plans are not enforceable in the same way as consent orders.

Enforceability flag

A parenting plan is a written, signed and dated agreement between the parents — it is not a court order. I make sure clients understand that if they want the arrangement enforceable, it needs to be filed as consent orders. I note which terms in the plan would sensibly translate into orders and which would not.

Best-interests analysis

I analyse the plan against section 60CC, covering the benefit of meaningful relationships with both parents, the need to protect from harm, the child's views (where appropriate), practical arrangements, and the capacity of each parent. I flag any arrangement that does not fit the factors.

Specific drafting issues

I flag vague language ("reasonable time"), missing holiday and special day schedules, unclear changeover arrangements, communication clauses that will not work in practice, and overseas travel provisions. Every parenting plan gets a "what happens when things go wrong" review.

Common issues
  • Parents often draft plans that work for the current school year only — I flag the need for school transition and long-term clauses
  • Holiday and changeover provisions are a common source of dispute — I make sure they are specific
  • Parenting plans that include money arrangements (school fees) need careful drafting — they are not child support
