Why use a deed of gift

A gift without consideration (not paid for) is unenforceable as a contract. Executing as a deed solves this — deeds are binding without consideration. Common uses: inter-generational wealth transfer; charity donations (where the donee requires documentation); gifts of shares or chattels requiring evidence of transfer; and pre-insolvency gift documentation (subject to claw-back risk).

Tax and duty implications

Gifts of real estate attract stamp duty in most states (although some concessions apply for transfers between spouses or to SMSFs). Gifts of assets trigger CGT on the donor under section 116-30 of the Income Tax Assessment Act 1997 (Cth) — market value substitution rule. Gifts made within the look-back period under bankruptcy law can be clawed back under the Bankruptcy Act 1966 (Cth) section 121.

Formal execution

To be valid as a deed, the instrument must be signed, sealed, and delivered. Modern practice: execution by individuals signed and delivered in the presence of an independent witness. Corporate execution under section 127 of the Corporations Act 2001 (Cth) — by two directors, or a director and secretary, or by sole director/secretary for single-shareholder companies. Electronic execution permitted under Part 4.1AA of the Corporations Act 2001 (Cth).

How I generate deeds of gift

Tell me the donor, donee, gift description, and any conditions. I produce a deed of gift in under a minute, in deed-compliant form. For estate planning and family lawyers this is a routine workflow — I handle the formalities so you can focus on the tax and estate planning advice.

Common issues
  • Gifts of real estate need transfer registration — the deed alone does not transfer title
  • CGT on gifts is calculated on market value — get a valuation
  • Gifts before bankruptcy can be clawed back — timing matters for insolvency planning
