How much does Legal Aid cost in NSW?

Who qualifies

Legal Aid NSW applies a means test (income and assets) and a merit test under the Legal Aid Commission Act 1979 (NSW). Centrelink recipients usually pass the means test automatically. The 2025-26 means test cut-off is around $62,000 disposable income for a single person and increases for dependants. Assets (excluding a modest home) are also tested.

Initial contribution fees

Most Legal Aid matters require a $75-$200 initial contribution. This is waived for applicants on a full pension or benefit. For higher-income applicants just inside the means test, initial contributions can be $500-$1,500. Non-payment can lead to Legal Aid being withdrawn.

Further contributions and charges over property

If the matter involves real property (family law property settlement, wills disputes) Legal Aid may register a charge over the property for its costs. At settlement or sale, Legal Aid recoups its fees. In some matters a further contribution is required based on outcome.

What Legal Aid does not cover

Legal Aid NSW does not usually cover commercial disputes, most civil litigation, most personal injury (covered by no-win-no-fee), or most consumer disputes. It covers criminal defence, family law (limited), care and protection, immigration (limited), and some tenancy matters. The Legal Aid NSW priority policies are published annually.
