How Quillio handles Fair Work modern awards
Australia has 122+ modern awards made under the Fair Work Act 2009 that set minimum terms and conditions for employees in specific industries and occupations. Quillio covers all current modern awards, including their classification structures, pay rates (updated annually after the Annual Wage Review), penalty rates, overtime provisions, allowances, and leave entitlements. I determine which award applies based on the employer's industry and the employee's duties, and then apply the specific provisions of that award.
Award coverage determination
The most important question in award interpretation is "which award applies?" I determine coverage based on the employer's principal business activity (for industry awards like the Hospitality Industry (General) Award 2020) or the employee's occupation (for occupation-based awards like the Clerks — Private Sector Award 2020). Where multiple awards could apply, I explain the coverage rules and the default hierarchy.
Classification and pay rates
Each award has a classification structure that determines the minimum pay rate. I map the employee's duties to the correct classification level and provide the current minimum rate (including the most recent Annual Wage Review increase). I also calculate penalty rates, overtime rates, and allowances based on the specific award provisions — these differ significantly between awards.
How I stay current
Modern awards are varied by the Fair Work Commission — new provisions, updated rates, and amended clauses are published regularly. The Annual Wage Review (typically effective from 1 July each year) updates all minimum rates. I am updated with these changes to ensure the rates and provisions I provide are current. I flag the effective date of any rate I cite so you can verify currency.
Common issues
- Award coverage can be disputed — the same employee might arguably fall under two different awards
- Annual Wage Review rates take effect from 1 July — ensure you are applying the current year's rates
- Award-free employees still have the NES as a safety net — the NES applies to all national system employees
