How to lodge a workers compensation claim in Tasmania
Workers compensation claims in Tasmania are governed by the Workers Rehabilitation and Compensation Act 1988 (TAS). Injured workers must notify their employer and lodge a claim with the employer's insurer. WorkCover Tasmania oversees the scheme. Claims cover medical expenses, weekly payments, and rehabilitation.
The framework
Workers compensation in Tasmania is governed by the Workers Rehabilitation and Compensation Act 1988 (TAS) and administered by WorkCover Tasmania.
The process
Report the injury to your employer
Notify your employer as soon as practicable after the injury or onset of illness. Follow up verbal notice in writing.
Seek medical treatment
Visit a doctor and obtain a workers compensation medical certificate. The certificate must describe the injury and your capacity for work.
Complete the claim form
Fill out a Workers Compensation Claim Form. Your employer should provide this, or download it from the WorkCover Tasmania website.
Submit the claim to your employer
Lodge the claim form and medical certificate with your employer. Keep copies for your records.
Employer forwards the claim to the insurer
Your employer must forward the claim to their workers compensation insurer within 3 business days.
Insurer assesses the claim
The insurer reviews the claim, may request additional medical information, and must make a provisional determination.
Receive the decision
The insurer will advise whether the claim is accepted or denied. Accepted claims provide weekly payments, medical expenses, and rehabilitation support.
Participate in rehabilitation
Engage with an approved rehabilitation program if required, to support your return to work.
Dispute the decision if needed
If the claim is denied, you can request a review through the Workers Rehabilitation and Compensation Tribunal (TAS) or seek conciliation through WorkCover Tasmania.
Consider a common law claim
If your injury resulted from employer negligence, you may also have a common law claim for damages. Seek legal advice about thresholds and time limits.
