What this tool does

Missing a limitation date is one of the most common sources of professional negligence claims against Australian lawyers. Limitation periods differ by jurisdiction and cause of action, and the exceptions — discoverability, disability, fraud — add further complexity. This tool gives you a quick reference point so you can triage deadlines before doing full research.

How to use it

  1. Select the Australian state or territory where the cause of action arose
  2. Choose the cause of action category (personal injury, contract, debt, property, defamation, etc.)
  3. Review the standard limitation period and the governing section of the relevant Limitations Act
  4. Check the listed exceptions — discoverability, disability extensions, fraud, and concealment
  5. Use the result as a starting point for your own deadline calculations, not a final answer

What you'll learn

  • Standard limitation periods for common causes of action in each Australian jurisdiction
  • How discoverability and latent injury rules extend or modify the standard period

Questions

Tool FAQs

Does this cover all causes of action?

It covers the most common civil causes of action — personal injury, contract, debt recovery, property damage, defamation, and negligence. Specialist areas like maritime, native title, and workers compensation have separate regimes and are flagged but not fully detailed.

How are the limitation periods sourced?

Each period is sourced from the relevant state or territory Limitation Act (or equivalent) and cross-referenced to the current version on the relevant legislation register.

Does it account for COVID-19 extensions?

Where a jurisdiction enacted temporary limitation period extensions during 2020-2022, those are noted against the relevant cause of action. Most have now expired, but the tool flags any that remain in force.

What about the discoverability rule?

The tool shows whether the jurisdiction applies a discoverability test for the relevant cause of action, and cites the statutory section. The application of discoverability to your specific facts requires legal analysis — the tool cannot do that for you.

Can I rely on this for a deadline?

No. This is a research aid, not legal advice. Always verify the limitation period against the current legislation and consider all relevant facts — including extensions, suspensions, and estoppel arguments — before setting a critical deadline.

Is the tool updated when legislation changes?

Yes. The data is reviewed quarterly and updated whenever a relevant amendment commences. The last-reviewed date is shown on the result page.
