Resolving a long service leave entitlement or payment dispute under Australian state legislation

The workflow
Identify the applicable legislation
Determine which state or territory long service leave Act applies based on where the employee is based (e.g. Long Service Leave Act 1955 (NSW), Long Service Leave Act 2018 (Vic)). Check whether an enterprise agreement or award provides a more generous entitlement.
Calculate continuous service
Calculate the employee's continuous service, accounting for any breaks that may or may not break continuity under the Act. Common issues include unpaid leave, workers' compensation absences, parental leave, and transfers between related entities.
Determine the entitlement
Apply the Act's formula to calculate the leave entitlement. In most jurisdictions, the standard is 2 months (8.67 weeks) after 10 years of continuous service. Calculate any pro rata entitlement on termination where the Act provides for it (typically after 5 or 7 years depending on the jurisdiction).
Calculate the correct rate of pay
Determine the rate of pay for long service leave. Most Acts require payment at the employee's ordinary rate of pay at the time of taking leave, which may include regular overtime, allowances, or loadings depending on the jurisdiction and the employee's pattern of work.
Send a formal demand or response
If acting for the employee, send a demand letter to the employer setting out the entitlement calculation and the amount claimed. If acting for the employer, prepare a response addressing each element of the claim with supporting calculations.
Lodge a complaint with the relevant authority
If the dispute is not resolved, lodge a complaint with the relevant state authority (e.g. NSW Industrial Relations for NSW, Wage Inspectorate Victoria for Vic). Many jurisdictions have an administrative process for investigating and determining claims.
Attend conciliation or mediation
Participate in any conciliation or mediation offered by the authority. Prepare a summary of the entitlement calculation, supporting documents, and the gap between the parties' positions.
Commence proceedings if unresolved
If the administrative process does not resolve the dispute, commence proceedings in the relevant court or tribunal (e.g. Industrial Relations Commission in NSW, Magistrates' Court in Victoria). Prepare evidence of the employment relationship, service period, and entitlement calculation.
