Preparing an Australian protection visa application (subclass 866)
A protection visa is granted where the applicant engages Australia's protection obligations under the Refugees Convention or the complementary protection regime. Claims must be substantiated with a detailed statement and supporting country evidence.
This is an 8-step workflow for preparing a subclass 866 protection visa application under s 36 of the Migration Act 1958 (Cth), engaging Australia's protection obligations under the Refugees Convention and complementary protection.
Before you start
- Applicant is lawfully in Australia or engages the bridging visa framework
- Identity documents and travel history available
- Reason for fearing return identified
- Legal aid/funding in place where applicable
The workflow
Take detailed protection claims
Take detailed claims through structured client interviews, using an interpreter where needed. Capture the who, what, when, where, and why of past harm and future fears.
Classify the claim
Classify the claim under the Refugees Convention (race, religion, nationality, political opinion, particular social group) or complementary protection grounds.
Apply the well-founded fear test
Apply the well-founded fear test — real chance of serious harm — and consider nexus to a Convention ground. Address whether state protection and internal relocation are available.
Gather country information
Gather country of origin information from DFAT, UNHCR, US State Department, Human Rights Watch, and current news sources to support the claims.
Collect corroborating material
Collect corroborating material — medical and psychological reports, witness statements, identity and ethnicity documents, and proof of past persecution.
Draft the statement of claims
Draft a detailed, chronological statement of claims in the applicant's voice, reviewed with the client and interpreter for accuracy.
Complete and lodge the application
Complete Form 866 and associated forms on ImmiAccount, attach supporting documents, and lodge with the Department of Home Affairs.
Prepare for the PV interview
Prepare the client for the protection visa interview, including practice questions, advice on interpreters, and updates to supporting material.
What you will have at the end
A lodged subclass 866 application with a complete evidentiary package, positioning the client for a Departmental decision and, if needed, a merits review before the ART.
Common issues
- Inconsistencies between the statement and the interview
- Missing corroborating country of origin information
- Failing to address internal relocation and state protection
- Not pursuing complementary protection where Convention grounds are marginal
- Late disclosure of claims that undermines credibility
