Preparing a subclass 189 skilled independent visa application
The 189 is a permanent visa for skilled workers not sponsored by an employer, state, or family member. It is points-tested and requires a positive skills assessment and an invitation to apply through SkillSelect.
This is an 8-step workflow for preparing a subclass 189 skilled independent (points-tested) visa application under Schedule 2 of the Migration Regulations 1994 (Cth).
Before you start
- Occupation on the MLTSSL
- Adequate English language result available
- Work and qualification evidence collated
- Age and health eligibility confirmed
The workflow
Confirm occupation eligibility
Confirm the nominated occupation is on the Medium and Long-term Strategic Skills List (MLTSSL) and identify the relevant skills assessing authority.
Obtain skills assessment
Obtain a positive skills assessment from the relevant assessing body (e.g. VETASSESS, Engineers Australia, ACS). Review any issues that may affect points.
Complete English testing
Ensure an acceptable English test result (IELTS, PTE, TOEFL, OET, or CAE) is available and still valid at time of invitation.
Calculate points score
Calculate the points score under the Points Test (Schedule 6D) — age, English, skilled employment, qualifications, partner skills, community language, study.
Submit SkillSelect EOI
Submit an Expression of Interest through SkillSelect with accurate claims. Update the EOI as circumstances change.
Respond to invitation to apply
On receipt of an invitation, prepare and lodge the visa application within the 60-day window. Pay the visa application charge.
Supply evidence for each claim
Upload documentary evidence supporting every points claim — employment references, payslips, tax documents, qualifications, and identity documents.
Manage health, character and final decision
Complete health examinations and police checks for every country of residence over 12 months since age 16. Respond to any RFIs from the Department.
What you will have at the end
A granted subclass 189 permanent visa that allows the applicant and included family members to live and work anywhere in Australia.
Common issues
- Inflated points claims that cannot be evidenced
- Overlooking partner skills claims
- Skills assessment obtained for the wrong occupation
- Health or character issues discovered late
- EOI updates not reflecting changes in circumstances
