What this calculator does

Victorian land tax is assessed annually on the total taxable value of all land owned as at 31 December (excluding the principal place of residence and primary production land). The Land Tax Act 2005 (Vic) sets out a general tax-free threshold and progressive rates, with a trust surcharge for non-fixed trusts and an absentee owner surcharge for foreign owners. A temporary COVID debt levy surcharge applies from 2024 to 2033.

Legal basis

Victorian land tax is imposed under the Land Tax Act 2005 (Vic). The principal place of residence exemption is in s 54. The trust surcharge (non-fixed trusts assessed from the first dollar) is in Part 3. The absentee owner surcharge sits in Part 5 (currently 4%). The COVID debt levy surcharge is imposed under the State Taxation Acts Amendment (COVID-19 Debt Repayment) Act 2023 (Vic).

How the calculation works

Apply the SRO Victoria progressive rate schedule under the Land Tax Act 2005 (Vic): nil below the general threshold, then marginal rates rising from 0.2% to 2.25% at the top. Non-fixed trusts are assessed from the first dollar at trust surcharge rates (no threshold). Absentee owners pay a 4% surcharge on the total taxable value of their residential land. Add the COVID debt levy surcharge (0.1% for values above $300,000, 0.25% above $1,800,000) for the 2024–2033 period.

What to do next

Is my principal place of residence taxed?

No — the principal place of residence is exempt under s 54 of the Land Tax Act 2005 (Vic). Conditions on occupancy and use apply.

What are the current thresholds?

The general threshold and rate bands are updated annually by the SRO Victoria. The calculator uses the figures as at the build date — confirm against sro.vic.gov.au for the current assessment year.

What is the absentee owner surcharge?

Under Part 5 of the Land Tax Act 2005 (Vic), absentee owners (foreign persons, foreign corporations, and absentee trusts) pay a 4% surcharge on the taxable value of their residential land, in addition to standard land tax.

What is the COVID debt levy?

The State Taxation Acts Amendment (COVID-19 Debt Repayment) Act 2023 (Vic) imposes a temporary surcharge on landholdings above $300,000 from 2024 to 2033, at 0.1% for $300,000–$1,800,000 and 0.25% above $1,800,000.

How are trusts assessed?

Non-fixed trusts (discretionary trusts) are assessed at trust surcharge rates from the first dollar — there is no tax-free threshold. Fixed trusts can access the general threshold if they meet the requirements in Part 3 of the Act.

What about vacant residential land tax?

The vacant residential land tax is a separate 1% levy on homes in specified inner-city Melbourne areas that are left vacant for more than 6 months. It is not modelled in this calculator.
