Legal basis
Queensland transfer duty is imposed under the Duties Act 2001 (Qld), Chapter 2. Rates and concessions are administered by the Queensland Revenue Office. The home concession sits under s 92 and the first home concession under s 93.
How the calculation works
Apply the QRO transfer duty rate schedule under the Duties Act 2001 (Qld) to the dutiable value. If the buyer will occupy as their home, apply the home concession (s 92) — a concessional rate on the first $350,000. If a first home buyer, apply the first home concession (s 93) — full exemption up to the lower threshold and a tapered concession to the upper threshold. If AFAD applies, add 8% Additional Foreign Acquirer Duty on the dutiable value.

How does the home concession work?
If the buyer will occupy the property as their principal home, the home concession under s 92 of the Duties Act 2001 (Qld) applies a concessional rate of 1% on the first $350,000 of dutiable value, with the standard rate on the balance. The property must be occupied within 12 months and held for at least 12 months.
What is the first home concession?
Under s 93 and the 2024 refresh, eligible first home buyers pay no duty on homes up to the lower threshold, with a tapered concession to the upper threshold. The buyer must not have previously owned residential property in Australia and must occupy within 12 months.
What is AFAD?
Additional Foreign Acquirer Duty (AFAD) is an 8% surcharge on the dutiable value where the acquirer is a foreign person or foreign corporation. The calculator adds it when the foreign purchaser flag is set.

Does it cover off-the-plan?
Queensland does not currently operate a standalone off-the-plan duty concession like NSW or Victoria. Standard rates and the home/first home concessions apply based on occupancy.
