Building defect claim deadline in Victoria
In Victoria, domestic building warranty claims under the Domestic Building Contracts Act 1995 (VIC) must be brought within six years for non-structural defects and ten years for structural defects, both running from the date of the occupancy permit (or the date of practical completion if no occupancy permit was issued). These are the longest building defect warranty periods of any Australian state.
Structural vs non-structural
Structural defects relate to the load-bearing elements of the building — foundations, footings, floor structures, walls (load-bearing), roof structures. Non-structural defects cover everything else — finishes, waterproofing (in some cases), fixtures, fittings, and non-load-bearing elements. Waterproofing defects are often disputed — they can be structural if they affect the building's integrity.
Who can claim
Under section 137C of the Building Act 1993 (VIC), implied warranties in domestic building contracts run with the land for the benefit of subsequent owners. The builder (registered building practitioner) is the primary defendant. Domestic Building Dispute Resolution Victoria (DBDRV) provides a mandatory conciliation process before VCAT proceedings.
