Can Quillio draft statements of claim?

Quick answer

Yes. I draft statements of claim for Supreme Court, District Court, and Federal Court matters from your instructions. I produce pleadings in current court format with numbered paragraphs, material facts, particulars, and prayers for relief. Common causes of action — breach of contract, negligence, misleading conduct under the Australian Consumer Law, equitable relief — are supported out of the box.

What you provide

Give me the parties, the facts in narrative form, the cause (or causes) of action you want pleaded, and the relief sought. I ask clarifying questions if I need more facts to plead the elements of a cause of action properly.

What you get back

A draft statement of claim in current court format with numbered paragraphs, material facts separated from particulars, and a prayer for relief. Each element of each cause of action is pleaded. I do not plead evidence — only material facts, as the rules require.

Where I stop

I will not plead a cause of action unless the facts you give me support its elements. If the facts do not support an element, I flag it and suggest what additional facts would be needed. This is the point of having me draft — I catch the gaps early.

Step-by-step
  1. Open the pleadings workflow. Select "Draft pleadings" and choose "Statement of claim".
  2. Provide instructions. Enter parties, facts, causes of action, and relief. I will ask clarifying questions if needed.
  3. Review the draft. I return a numbered draft with material facts and particulars separated. Each cause of action is labelled.
  4. Edit and file. Edit in Word, have counsel review, and file through your court portal.
Common issues
  • Pleadings that mix facts with evidence get struck out — I separate them but you should check on review
  • Limitation periods are not pleaded as part of the claim — I flag them separately so you can consider them
  • Misleading conduct claims under section 18 ACL need the representation pleaded specifically — give me the exact words if possible
